§ 1 Anbieter und Geltungsbereich

§ 1 Provider and Scope

1. Diese Allgemeinen Geschäftsbedingungen gelten für alle Aufträge zur Erstellung von Immobiliengutachten, Wertermittlungen und damit zusammenhängenden Beratungsleistungen, die zwischen dem Auftraggeber und folgendem Anbieter geschlossen werden:

§ 2 Leistungsbeschreibung

§ 2 Service Description

1. Der Anbieter erstellt auf Basis des erteilten Auftrags Gutachten zur Immobilienwertermittlung. Das Leistungsangebot umfasst insbesondere:

• Verkehrswertgutachten gemäß § 194 BauGB
• Market value appraisals pursuant to § 194 BauGB
• Kurzgutachten und Plausibilitätsgutachten
• Short appraisals and plausibility assessments
• Immobilienbewertung und -beratung
• Property valuation and advisory
• Sonstige gutachterliche Stellungnahmen nach Vereinbarung
• Other expert opinions by agreement

2. Der verantwortliche Sachverständige Ismail Tahir ist Mitglied der Royal Institution of Chartered Surveyors (MRICS) und handelt nach den Berufsstandards der RICS (RICS Rules of Conduct).
3. The responsible expert Ismail Tahir is a member of the Royal Institution of Chartered Surveyors (MRICS) and acts in accordance with the professional standards of RICS (RICS Rules of Conduct).

3. Das Gutachten dient ausschließlich dem vertraglich vereinbarten Zweck. Eine Verwendung für andere Zwecke oder durch Dritte bedarf der ausdrücklichen schriftlichen Zustimmung des Anbieters.
4. The appraisal is intended solely for the contractually agreed purpose. Use for other purposes or by third parties requires the express written consent of the Provider.

4. Berechnungen und Einschätzungen im Gutachten basieren auf den zum Zeitpunkt der Erstellung verfügbaren Marktdaten und übermittelten Unterlagen. Der Anbieter übernimmt keine Gewähr für eine bestimmte Wertentwicklung der Immobilie nach Gutachtenerstellung.
5. Calculations and assessments in the appraisal are based on market data available at the time of preparation and documents provided. The Provider does not guarantee any particular value development of the property after the appraisal is completed.

§ 3 Vertragsschluss und Auftragserteilung

§ 3 Contract Formation and Order Placement

1. Der Vertrag kommt durch schriftliche Auftragserteilung (per E-Mail oder Brief) und die schriftliche Auftragsbestätigung des Anbieters zustande.
2. The contract is formed by written placement of the order (by email or letter) and the Provider's written order confirmation.

2. Der Auftraggeber ist verpflichtet, alle für die Gutachtenerstellung relevanten Unterlagen (z. B. Grundbuchauszug, Baupläne, Mietverträge) vollständig und wahrheitsgemäß zur Verfügung zu stellen.
3. The client is obliged to provide all documents relevant to the preparation of the appraisal (e.g. land register extract, building plans, rental agreements) completely and truthfully.

3. Der Anbieter ist berechtigt, einen Auftrag ohne Angabe von Gründen abzulehnen.
4. The Provider is entitled to decline an order without stating reasons.

§ 4 Vergütung und Zahlung

§ 4 Fees and Payment

1. Das Honorar wird individuell nach Art und Umfang des Gutachtens vereinbart und im Angebot ausgewiesen. Es versteht sich inklusive der gesetzlichen Mehrwertsteuer (19 %).
2. The fee is agreed individually according to the type and scope of the appraisal and stated in the quotation. It is understood to be exclusive of statutory VAT (19%).

2. Der Anbieter ist berechtigt, eine angemessene Anzahlung zu verlangen. Einzelheiten werden im Angebot geregelt.
3. The Provider is entitled to request a reasonable advance payment. Details are set out in the quotation.

3. Rechnungen sind innerhalb von 14 Tagen nach Ausstellung ohne Abzug zu begleichen.
4. Invoices are to be settled within 14 days of issue without deduction.

4. Bei Zahlungsverzug gelten die gesetzlichen Verzugszinsen.
5. In the event of late payment, statutory default interest applies.

§ 5 Mitwirkungspflichten des Auftraggebers

§ 5 Client Obligations to Cooperate

1. Der Auftraggeber stellt alle für die Gutachtenerstellung erforderlichen Unterlagen rechtzeitig und vollständig zur Verfügung.
2. The client shall provide all documents required for the preparation of the appraisal in a timely and complete manner.

2. Der Auftraggeber ermöglicht dem Gutachter auf Anfrage die Besichtigung des Bewertungsobjekts zu einem abgestimmten Termin.
3. At the request of the appraiser, the client shall enable an inspection of the property to be valued at an agreed appointment.

3. Bei nachträglichen Änderungen des Auftragsumfangs durch den Auftraggeber ist der Anbieter berechtigt, das Honorar entsprechend anzupassen und die Bearbeitungszeit neu zu vereinbaren.
4. In the event of subsequent changes to the scope of the order by the client, the Provider is entitled to adjust the fee accordingly and to agree a new processing time.

4. Verzögert sich die Gutachtenerstellung durch mangelnde Mitwirkung des Auftraggebers, verlängert sich die vereinbarte Bearbeitungszeit entsprechend. Die Pflicht zur Vergütung bleibt unberührt.
5. If the preparation of the appraisal is delayed due to the client's lack of cooperation, the agreed processing time shall be extended accordingly. The obligation to pay the fee remains unaffected.

§ 6 Bearbeitungszeit und Lieferung

§ 6 Processing Time and Delivery

1. Die Bearbeitungszeit wird individuell vereinbart und beginnt mit dem vollständigen Eingang aller erforderlichen Unterlagen sowie der geleisteten Anzahlung, sofern eine solche vereinbart wurde.
2. The processing time is agreed individually and begins upon complete receipt of all required documents and the advance payment, if one has been agreed.

2. Das fertiggestellte Gutachten wird dem Auftraggeber in der vereinbarten Form (digital und/oder in gedruckter Ausfertigung) übergeben.
3. The completed appraisal is handed over to the client in the agreed form (digital and/or printed copy).

3. Mehrfertigungen und zusätzliche Ausfertigungen des Gutachtens werden nach Aufwand berechnet.
4. Additional copies of the appraisal are charged according to the actual effort involved.

§ 7 Widerrufsrecht

§ 7 Right of Withdrawal

1. Verbrauchern steht ein gesetzliches Widerrufsrecht zu. Die vollständige Widerrufsbelehrung ist als separates Dokument erhältlich und wird bei Vertragsschluss übermittelt. Sie ist außerdem abrufbar unter Widerruf.html.
2. Consumers are entitled to a statutory right of withdrawal. The complete cancellation policy is available as a separate document and is provided at the time of conclusion of the contract. It is also available at Widerruf.html.

Das Widerrufsrecht erlischt vorzeitig, wenn der Auftraggeber ausdrücklich zustimmt, dass der Anbieter vor Ablauf der Widerrufsfrist mit der Ausführung der Leistung beginnt, und der Auftraggeber gleichzeitig bestätigt, dass er mit Beginn der vollständigen Leistungserbringung sein Widerrufsrecht verliert (§ 356 Abs. 4 BGB).
3. The right of withdrawal expires early if the client expressly agrees that the Provider begins performing the service before the end of the withdrawal period, and the client simultaneously acknowledges that the right of withdrawal is lost upon commencement of full performance (§ 356 (4) BGB).

§ 8 Gewährleistung und Haftung

§ 8 Warranty and Liability

1. Der Anbieter haftet unbeschränkt bei Vorsatz und grober Fahrlässigkeit sowie für Schäden aus der Verletzung von Leben, Körper oder Gesundheit.
2. The Provider is liable without limitation for intent and gross negligence as well as for damages arising from injury to life, body, or health.

2. Bei leichter Fahrlässigkeit haftet der Anbieter nur bei Verletzung einer wesentlichen Vertragspflicht, begrenzt auf den bei Vertragsschluss typischerweise vorhersehbaren Schaden.
3. In the case of minor negligence, the Provider is only liable for breach of a material contractual obligation, limited to the damage typically foreseeable at the time of conclusion of the contract.

• Schäden aufgrund unvollständiger oder unrichtiger Angaben und Unterlagen des Auftraggebers
• Damages due to incomplete or incorrect information and documents provided by the client
• Die Verwendung des Gutachtens zu anderen als dem vereinbarten Zweck oder durch nicht berechtigte Dritte
• Use of the appraisal for purposes other than those agreed or by unauthorised third parties

4. Einwendungen gegen das Gutachten sind innerhalb von vier Wochen nach Übergabe schriftlich beim Anbieter geltend zu machen.
5. Objections to the appraisal must be raised with the Provider in writing within four weeks of delivery.

§ 9 Datenschutz

§ 9 Data Protection

1. Der Anbieter verarbeitet personenbezogene Daten gemäß der Datenschutzerklärung, abrufbar unter Datenschutz.html.
2. The Provider processes personal data in accordance with the privacy policy, available at Datenschutz.html.

2. Im Rahmen der Auftragsbearbeitung übermittelte Unterlagen und Daten werden vertraulich behandelt und nicht ohne Zustimmung an Dritte weitergegeben, soweit dies nicht zur Vertragserfüllung erforderlich ist.
3. Documents and data submitted in the course of processing the order are treated confidentially and are not passed on to third parties without consent, unless this is necessary for the performance of the contract.

§ 10 Schlussbestimmungen

§ 10 Final Provisions

1. Es gilt deutsches Recht. Für Verbraucher gilt dies nur, soweit dadurch nicht der Schutz zwingender Verbraucherrechte des Wohnsitzstaates eingeschränkt wird.
2. German law applies. For consumers, this applies only insofar as it does not restrict the protection of mandatory consumer rights of the country of residence.

2. Gerichtsstand für Unternehmer ist Offenbach am Main. Für Verbraucher gilt der gesetzliche Gerichtsstand.
3. The place of jurisdiction for entrepreneurs is Offenbach am Main. For consumers, the statutory place of jurisdiction applies.

3. Sollten einzelne Bestimmungen dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.
4. Should any individual provisions of these Terms be invalid, the validity of the remaining provisions shall remain unaffected.
